Should not happen, but unfortunately happens again and again - airlines sell more tickets than basically seats are available on the plane! The reason is that they calculate that a certain percentage will be canceled out of experience. But if this changes, the situation is very unpleasant for both the passengers and the flight crew.
Also for this problem the right to compensation payments is legally regulated. But please note that there are also "priority rules" for overbooked flights. For example, airline personnel are required to offer seats to persons with reduced mobility, their accompanying persons or even children traveling alone. This means that in case of overbooking, the purchase date of the ticket does not count first!

Who is entitled to compensation?

In order to determine whether you have a claim, please quickly go through the following checklist and make sure you meet all of the criteria:

  • You have a confirmed booking as well as a ticket issued under your name
  • Your booked flight takes off from an EU airport, or it is provided by an airline headquartered within the EU and lands at an EU airport
  • You were at the check-in counter on time (either the time stipulated in the booking confirmation or no later than 45 minutes prior to flight departure)
  • You gave no cause to be denied transportation, such as representing a danger to the health of the other passengers or a safety risk of general or operational nature
  • You were not flying at a free/reduced rate not directly or indirectly available to the general public

Compensation

Assuming that you meet all of the criteria mentioned above, you have a right to all of the following:

  • Full reimbursement of the ticket price
  • Free return flight or alternate form of transportation (rail) to the departure point at the earliest possible point in time
  • In providing you with transportation to your target destination, your personal preferences must be taken into account (insofar as space is available)
  • Reimbursement for necessities such as meals, drinks, telephone calls and emails
  • Right to compensation of 250 euro for a total flight distance of under 1500 km
  • Right to compensation of 400 euro for a total flight distance of 1500 to 3500 km
  • Right to compensation of 600 euro for a total flight distance of over 3500 km
