With respect to rebooked flights, you must be aware of the following points:

You have no right to compensation if you were notified more than 14 days in advance of the flight.

Compensation Payments for Re-Booked Flights

Delays, cancellations or overbookings – all of these circumstances can lead to you being rebooked on a different flight. Under certain conditions, you as a passenger have a right to compensation up to €600. In this case, EU regulation 261/2004 would apply, which regulates the amount of, as well as the conditions under which you might receive compensation. Decisive when determining your claim is the extent of your delayed arrival at your destination airport.

The Requirements

You are entitled to a compensation payment if you meet the following criteria:

  • You possess a valid airline ticket, which was not procured at a reduced price not otherwise available directly to the general public.
  • It does not matter whether you booked this flight with the airline directly or by means of an online platform, or if the flight was part of a package holiday or a business trip.
  • Adults as well as children with a paid ticket have a right to compensation.
  • The airplane either took off or landed in the EU, and the providing airline is headquartered in the EU.
  • The rebooked flight took place less than 3 years ago.
  • You arrived at the check-in counter on time, in other words at least 45 minutes prior to departure. Also double-check whether a different time for latest possible check-in was printed on your ticket.
  • The flight was delayed by more than 3 hours
  • The flight in question was not affected by any extraordinary circumstances such as strikes, unusual weather conditions or political unrest.
  • You did not represent a safety or health risk to the other passengers.
  • The information pertaining to the rebooking was supplied to you fewer than 14 days prior to departure.

Demanding compensation – what you should be aware of

Fundamentally, if you wish to claim compensation you should address your demands to the airline that was providing the service. Unfortunately, it is often the case that airlines use various tactics in order to avoid or delay paying out compensation. How much compensation do you have a right to? The amount of compensation in the event of a flight delay of more than 3 hours is determined by the flight distance. If this distance is less than 1500 km, then the passenger is entitled to receive €250. If the distance is between 1500 km and 3500 km, compensation is €400, while for distances of more than 3500 km, the amount is €600.
Rebooking of business trips
If the rebooking pertains to a business trip, you are also eligible for compensation. Eligibility pertains to the actual traveler and not to the company who is paying for the trip. That is to say, unless different arrangements have been agreed to within the company itself, specifying that the passenger agrees to relinquish their personal rights to various forms of compensation. In many countries within the EU, such compensation is not taxable – however, this is something you should check with your tax advisor.

Additional Support Services

If, due to a delay caused by a rebooking, you are forced to wait a long time at the airport, you have a right to additional support services. If your wait is 2 hours or longer, you have a right to meals as well as drinks. These support services are stipulated as follows:

  • For flights of 1500 km or less, you have a right to support services in the event of delays of 2 hours or more.
  • For flights between 1500 km and 3500 km, in the event of delays of 3 hours or more.
  • And for flights of 3500 km or more, delays of 4 hours or longer.
  • If you are rebooked to a flight on the following day, you also have the right to a free hotel room.
  • If your flight is delayed by more than 5 hours, you also have a right to cancel your flight booking.

Please note, however, that regardless of the support services provided to you by the airline, this in no way diminishes your right to compensation.
